Most estate plans don?t work; it?s absolutely true (and shocking.) Most estate plans don?t work for two reasons. First, assets aren?t owned properly and second, estate plans aren?t updated.

Proper Asset Ownership

Assets must be aligned with your estate plan.

For example, if you want your trust to control assets, avoid probate, provide asset protection, and outline instructions for when you are disabled or die, the trust must own the assets. Otherwise, the trust has no control over your assets and your estate plan will fail.

A second example would be using your will to dispose of assets at your death. If you want your will to control assets and get them to certain people, you must own your assets in your individual name.

Assets in the name of your trust, owned jointly (with survivorship), or which have a beneficiary designation (i.e. life insurance and retirement accounts) are NOT controlled by your will.

This means that if you include provisions in your will to give $50,000 to each child, but own everything jointly with your spouse, your children will get nothing and your estate plan fails.

Updating Your Estate Plan

Estate plans need to be updated every three to five years?.even sooner, if you experience a significant life change such as a new child or spouse.

All estate plans experience three types of changes:

  • Changes in the law
  • Changes in your personal situation (finances, goals, family, and situation)
  • Changes in your estate planning attorney?s planning methods

If you have a qualified estate planning attorney, he or she will be constantly striving to implement new techniques to make your estate plan more effective.

If you want your estate plan to work, make sure you own all of your assets properly and update your estate plan.? Otherwise, your plan will, likely, fail.

(AP) ? The shooting at a Southern California federal building of a high-ranking Immigration and Customs Enforcement official was over an unspecified disciplinary matter, a person familiar with the case told The Associated Press Friday.

Authorities haven't elaborated what led to Thursday's shooting at the Glenn M. Anderson Federal Building in Long Beach, but apparently it was over a dispute between the gunman and the wounded man, said the person who requested anonymity because the investigation is ongoing.

A law enforcement official also told the AP that the person wounded is a high-ranking ICE official and the agent who was killed was a subordinate who did not report directly to the man he shot. The official also requested anonymity because of a lack of authorization to release details.

A third agent intervened and shot the gunman to prevent more rounds being fired at the victim, the FBI said.

The gunman died at the scene and the wounded agent was hospitalized at St. Mary Medical Center. ICE Special Agent in Charge Claude Arnold would only say he was stable.

St. Mary's hospital trauma director James Murray told KCAL-TV that the injured agent had multiple gunshot wounds, but he didn't give details. The victim's vital signs were "good for now," Murray said.

The names of the dead gunman, the victim and the agent who fired the final rounds were not released.

The shooting happened just before 6 p.m. Thursday on the seventh floor of the Glenn M. Anderson Federal Building in Long Beach, about 20 miles south of downtown Los Angeles.

It was described by the FBI's Steven Martinez as a case of "workplace violence involving two federal agents in their office space." He offered no other details about what led to the initial shooting

There were conflicting early reports about the number of people shot, with local authorities saying two were dead and one wounded, while ICE said one was dead and one wounded.

The Long Beach federal building houses ICE, the Internal Revenue Service and the U.S. Probation and Parole Office.

"At times like this, words honestly seem inadequate. When something like this happens in our offices, it's incomprehensible," Arnold said.

Along with the FBI, the shooting was being investigated by ICE's Office of Professional Responsibility and Long Beach police.

Greece still to convince Europe over rescue deal (Reuters)

ATHENS/BRUSSELS (Reuters) ? Europe gave Greece until Wednesday to convince skeptical international creditors that it would stick to the punishing terms of a multi-billion-euro rescue package, endorsed by parliament as rioters torched downtown Athens.

Lawmakers backed drastic cuts in wages, pensions and jobs on Sunday as the price of a 130 billion euro ($170 billion) bailout by the European Union and International Monetary Fund to avert a messy default that would send shockwaves through the euro zone.

Scenes of running battles between police and rioters and flames engulfing cinemas, shops and banks underscored a sense of deepening turmoil in the country after more than four years of recession and two of punishing austerity.

The EU warned on Monday that the consequences of failure would be "devastating."

It gave the fragile ruling coalition of Prime Minister Lucas Papademos until Wednesday, when euro zone finance ministers are expected to meet, to specify how 325 million euros of the 3.3 billion euros demanded in budget savings will be achieved.

By the same deadline, Greek political leaders must give a written commitment to implement the terms of the deal, a Greek government spokesman said, reflecting fatigue among EU leaders who say they have heard enough broken promises.

The spokesman said Greece would hold an election in April, when deep public anger over the second round of austerity could drive voters further to the left and right and test Greece's commitment to the programme.

Euro zone paymaster Germany said ahead of the vote that it was losing patience with throwing money into the "bottomless pit" of Greece's debt crisis. Official reaction from Berlin on Monday was muted.

"Now we need to wait and see what comes after the legislation," Economy Minister and deputy Prime Minister Philipp Roesler said on German television.

"We have taken one step in the right direction but we are still far from the goal," he said.

Greece needs the international funds before March 20 to meet debt repayments of 14.5 billion euros.

EU Economic and Monetary Affairs Commissioner Olli Rehn said a disorderly default would have devastating consequences for Greek society.

"I am quite confident that the other conditions, including the identification of concrete measures of 325 million euros, will be completed by the next meeting of the Eurogroup, which would then decide on the adoption of the programme," he said.

"SOCIAL EXPLOSION"

The deal provides for a bond swap to ease Greece's debt burden by cutting the real value of private-sector investors' bond holdings by some 70 percent.

Sources familiar with the private sector debt talks said the terms would be announced after euro zone finance ministers meet on Wednesday, assuming there are no further setbacks.

They will include a new average interest rate of 3.5 percent for bondholders and an additional warrant linked to Greek growth, one of the sources said.

"It will be concluded in March," Greek government spokesman Pantelis Kapsis said of the debt swap deal.

Asian shares and the euro gained modestly on Monday and

bank shares led European stocks higher.

Papademos is likely this week to replace one minister and five deputies who quit over the rescue bill. He had warned of a "social explosion" if lawmakers rejected the deal and Greece defaulted.

But the unrest in the streets, and a voting rebellion by 43 parliamentarians of the ruling coalition, suggested Athens might already be on the brink.

The riots spread to Greece's second city of Thessaloniki, towns across the country and the islands of Crete and Corfu. In all, 150 shops were looted in the capital and 93 buildings set ablaze, wrecked or seriously damaged.

About 100 people - including 68 police - were wounded and 130 detained.

Athens city authorities said some of the wrecked buildings were of particular cultural, historic and architectural value.

The Attikon cinema, housed in a neo-classical building dating from 1870, was left a blackened shell.

"The people yesterday sent a message: Enough is enough! They can't take it anymore," said Ilias Iliopoulos, general secretary of public sector union ADEDY.

GROUNDSWELL OF ANGER

The cuts include a 22 percent reduction in the minimum wage and 150,000 jobs from the public sector workforce by 2015.

Critics on Monday said more austerity would only condemn the economy to an ever-deepening downward spiral, but Greek political leaders have offered few alternatives.

Conservative New Democracy leader Antonis Samaras says the country should focus more on stimulating growth with tax cuts and privatization.

Some ordinary Greeks say they have heard enough threats of economic armaggedon, and that a messy default can be no worse than the painful medicine they are currently being made to swallow.

"Yesterday's vote in the parliament may have saved the country temporarily from default, but the Greek economy is going bankrupt and the country's political system is failing," the head of the Greek Commerce Confederation, Vassilis Korkidis, said.

The rioters were a minority, but spoke to the groundswell of anger among Greeks who say their living standards are already collapsing and more austerity will only deepen their misery.

Unemployment in Greece reached 20.9 percent in November, and half of young Greeks are jobless.

Samaras is the frontrunner to be the next prime minister, but will likely have to bargain with other parties to form a coalition after the April election.

In comments that could further sow doubt in Brussels, he indicated that Athens might yet try to renegotiate the deal.

"I am calling on you to vote for the new loan agreement because I want to avoid falling into the abyss, to restore stability," he told Sunday's parliamentary debate, "so that we can have the possibility tomorrow to negotiate and change the policy that is being imposed upon us today."

Love and Loss in Relationships | The Emotionally Sensitive Person

HalfheartWhether you believe in celebrating Valentine?s Day or not, the day serves as a reminder to many of the relationships they have lost or their lack of success in creating supportive relationships. The pain of being alone, for many, ?is constantly present but may be more intense on a day that celebrates love.

Relationships can be a roller-coaster ride for the emotionally sensitive. Emotionally sensitive people often love fiercely and intensely. They also become hurt, angry and sad more quickly and more intensely than others do. Their emotions sometimes lead to relationships with lots of ups and downs.

They may love their partner or friend but frequently be so angry and hurt they cannot be around the person, perhaps over an issue that others do not understand. They may believe that they hate a person at a certain time and they do. They may believe they never want to speak with or see the person again. But those thoughts, based on feelings of hurt and anger, often fade after the emotions pass. Then they are often racked with shame that they pushed someone away.

Shame blocks relationships. Because of their shame, some have difficulty acknowledging that they acted on emotions that they no longer feel. That acknowledgement can seem like their feelings were wrong and that is invalidating of their experience, which was real and true to them at the time. They may believe that makes them ?wrong? as a person, inadequate or broken. Actually, most often the emotionally sensitive are acting on a thought or experience that is completely understandable, but their reactions are more intense than others may be able to understand.

The loss of relationships can be traumatic. Sometimes the ups and downs that the emotionally sensitive experience end in the loss of a relationship. Others may become confused or frustrated with the emotional changes. The loss of a relationship is so painful for many that they often do not know how to cope. For some, they decide relationships aren?t worth the pain. They withdraw and avoid relationships. Others may blame themselves and feel deep anger that they aren?t able to maintain relationships. They then attempt to push their emotions down, attempting to not express them. They may succeed for a time. But emotions cannot stay pushed down without some consequence. For example, some individuals may ?blow up,? and hate themselves for failing to keep their emotions in check. Pushed down emotions can also have other consequences such as health problems.

Loss of a relationship occurs for many other reasons. Sometimes it is the cycle of life, that everything changes and nothing is permanent but change. Loved ones may move away or die. There may be arguments that aren?t resolved or disappointments that aren?t forgiven.

Sometimes the emotionally sensitive experience a kind of traumatic reaction around relationships. Perhaps because of a history of lost relationships, perceived/actual rejections, an insecure or neglectful relationship with their parents, or other past experiences, the emotionally sensitive may be hyper-alert for any signs of ?judgment, neglect, or discontent by others. This hyper-alertness is a part of protecting themselves but often leads to the very result they fear: the loss of a relationship. They may blame others or themselves, but the pain is intense either way.

Letting go of a relationship, regardless of the reason, is often one of the most difficult situations for the emotionally sensitive. When they have feel the loss of a relationship, the emotionally sensitive are in agony. They often describe themselves as feeling empty and alone. They long for the return of the relationship. Sometimes that longing is not logical but based on pure feeling. They want the relationship they had before the disruption that occurred.

The pain of not having it can be overwhelming. They may act in ways that are further destructive, such as repeated calling or defending themselves to salvage the relationship. They may also be self-destructive in trying to alleviate their pain.

A Few Coping Strategies

When suffering the pain of a loss of a relationship, distracting yourself is one way of coping. Finding a way to give yourself a break from the pain helps your resiliency. An activity that absorbs your attention is best. You may also remind yourself that though you think you will never recover, emotions do fade over time.

Finding comfort in others or providing comfort and compassion to yourself is important. Getting involved in helping others and focusing on being kind to others works for some. Seeking solace in spirituality and in finding meaning to the experience may help you cope until the pain is no longer so acute.

Finally, learning from the experience and developing new skills, whether in maintaining new relationships or in choosing people with whom to have relationships, may help change a repetitive pattern.
